Terms of Service
These Terms of Service ("Terms") govern your access to and use of IP-Atlas (the "Service"), operated by Trellis Digital Services LLC, a limited liability company ("Company", "we", "us"). By accessing or using the Service you agree to these Terms.
1. The Service
IP-Atlas provides a REST API and downloadable MMDB files for IP geolocation, ASN/organisation lookup, and datacenter detection. We derive this data from publicly available Regional Internet Registry feeds and from Company-maintained metadata about hosting providers.
2. Accounts and API keys
Access to the Service is controlled by API keys issued after card authorisation via our payment processor (Stripe). Every account — including Free — requires a card on file. We do not charge at signup; the card is only charged if you exceed your plan's quota and have Automatic Overage Billing enabled.
You are responsible for keeping your API key confidential. Any request authenticated with your key is billed to your account. If you believe a key has been disclosed, rotate it from the dashboard or contact support@ip-atlas.io.
3. Plans, pricing, and overage
Current plans are listed at ip-atlas.io/#pricing. The Pro subscription is billed annually at $228/year on the subscription anniversary date. Pay-as-you-go charges accrue per use and are billed monthly via Stripe. Monthly request quotas reset on the first day of each calendar month UTC.
Automatic Overage Billing is enabled by default on every plan. When your monthly usage exceeds your plan's included quota, additional requests continue to succeed and are charged at $0.40 per 1,000 requests on the 1st of the following month via Stripe Invoice Items. You may disable overage billing (requests will then return 429 at quota) or set a hard monthly spend cap on your dashboard at any time.
We may change pricing or plan features with at least 30 days' notice to your billing email. Continued use after the change takes effect is acceptance of the new terms.
3.1 Free tier — non-commercial use only
The free tier (2,000 API requests/month, or one country-level MMDB download) is licensed for non-commercial use only. This includes personal projects, hobby sites, internal tools at organisations with under $1M in annual revenue, and evaluation before purchasing a paid plan. Commercial use requires a Pro subscription. Using the free tier in violation of this clause is a material breach of these Terms and grounds for immediate revocation.
4. Acceptable use
You will not, and will not permit any third party to:
- Resell, redistribute, or republish IP-Atlas data as a standalone dataset or competing service;
- Scrape, cache, or persist responses in a way that circumvents quota enforcement for additional end-users beyond the licensed scope of your plan;
- Attempt to disrupt the Service through abuse, denial-of-service, or vulnerability exploitation;
- Share a single API key across independent legal entities (each customer needs their own account);
- Use the Service in connection with any activity that violates applicable law.
We may suspend or revoke your key without refund if we determine in good faith that you have violated this section.
5. Service level
The Service is provided on a best-effort basis. We publish live availability data at ip-atlas.io/status. Scheduled maintenance windows are announced at least 24 hours in advance where practical.
6. Data accuracy
IP intelligence data is probabilistic. While we take reasonable care to keep our data fresh and accurate, we make no warranty that any specific lookup is correct. You must not rely on the Service as the sole basis for decisions that materially affect individuals (such as identity verification or fraud determinations) without independent corroboration.
7. Payment, refunds, and cancellation
All payments are processed by Stripe. See our Refund Policy for details. You may cancel a paid subscription at any time from the billing portal; access continues through the end of the paid period, after which your key returns to Free-tier quotas (or is revoked if the key was only issued for the paid tier).
8. Intellectual property
The Service, including its APIs, documentation, and branding, is the property of the Company. You retain ownership of any data you send to the Service. Company grants you a non-exclusive, non-transferable license to use the API responses within your own products for the duration of your subscription, subject to Section 4.
9. Confidentiality and security
We store only what we need to operate the Service: your email address; a bcrypt hash of your password; a SHA-256 hash and short display prefix of each API key; per-key request counts; your Stripe customer identifier; session records; an account-security audit log; and, if you enroll two-factor authentication, an encrypted TOTP secret or WebAuthn credentials. We do not log the IP addresses you query nor the contents of your API requests or responses. See our Privacy Policy for the complete list and retention periods.
9a. Eligibility
You must be at least 18 years old to create an account or use the Service. By using the Service you represent that you meet this requirement and that you have the authority to enter into these Terms on behalf of yourself or any organization you represent.
9b. Force majeure
The Company is not liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, pandemic, governmental action, power or network failures, internet or cloud-provider outages, or the failure of third-party services on which the Service depends.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. YOU USE THE SERVICE AT YOUR OWN RISK.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY'S AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO THE COMPANY FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT WILL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its affiliates from any claim, loss, or expense (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party right.
13. Termination
You may terminate your account at any time by cancelling your subscription. We may suspend or terminate your access for material breach of these Terms, with written notice where feasible. Sections 4 (Acceptable Use), 8 (IP), 10 (Disclaimer), 11 (Liability), 12 (Indemnification), and 15 (Governing Law) survive termination.
14. Changes to these Terms
We may update these Terms from time to time. The current version is always at this URL. Material changes will be emailed to active subscribers at least 30 days before they take effect. Continued use after the effective date is acceptance of the revised Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute arising from or relating to these Terms will be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming, and the parties consent to personal jurisdiction there.
